Terms of Service

This Terms of Service Agreement ("Agreement") is entered into by and between the party accepting this Agreement ("you," "your," or "Customer") and Litigators.org Inc. ("we," "us," or "our"). This Agreement becomes effective immediately when you subscribe to or use our Service.

Through our platform, we provide Litigation Management (the "Service"), which delivers data analytics and attorney referral services. The Service provides subscribers with access to our analytical platform, attorney matching capabilities based on proprietary data from Premonition LLC, and related features as described on our website.

litigators.org refers clients to the best available attorney suitable for their legal matter and jurisdiction. litigators.org provides attorney referrals based on the statistically sound methods developed by Premonition LLC. Those methods entail using proprietary data to determine which attorneys have the best win rates for the client's particular legal matter and/or in front of the client's particular judge. Where win rates cannot be effectively evaluated, litigators.org will utilize other important proprietary data such as attorney case durations and judge contributions to find the best attorney for their client.

The litigators.org mark is the property of litigators.org and is intended solely for the purpose of marketing Premonition services, and not for the practice of law.

We use automated personas for marketing and quality assurance purposes.

2. Right to Use the Service

License Grant: We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with your Subscription level and this Agreement. We reserve all other rights not expressly granted.

You acknowledge that Litigators.org Inc. has no obligation to maintain the confidentiality of any information you submit to us. However, Litigators.org Inc. is committed to making reasonable efforts to protect the confidentiality of your information and delivering high quality service. Any information you provide via this website will be used to identify your legal needs and enable us to properly serve you. We will store the information you provide on secure servers, and access to it will be restricted to Litigators.org Inc. employees and agents. We will not rent, sell or trade your personal or organizational information to others.

Our company uses a remarketing advertising service. When visitors come to our site, third parties (such as AdRoll) may place cookies on your browsers for targeted advertising purposes. You can opt-out of receiving targeted ads at networkadvertising.org/choices.

6. Attorney-Client Relationship

Information provided to Litigators.org Inc. via this website or otherwise communicating information to Litigators.org Inc. will not establish an attorney-client relationship. Information you provide to Litigators.org Inc. will not be afforded legal protection as an attorney-client communication.

This means that while Litigators.org Inc. will protect the confidentiality of your information in accordance with our Privacy Policy, the information you provide is not protected under the laws relating to attorney-client privilege. Litigators.org Inc. may be compelled to disclose information you provide in certain legal proceedings. Accordingly, you should not provide any information concerning your legal needs that you wish to be protected by attorney-client privilege.

7. Consent to Compensation for Referrals

You acknowledge that Litigators.org Inc. engages in the business of providing attorney referrals based on the statistically sound methods developed by Premonition LLC. You further acknowledge that Litigators.org Inc. provides these referrals in exchange for compensation from the attorney receiving the case in accordance with applicable rules of the specific jurisdiction involved.

Because Litigators.org Inc. seeks to pair the client with the attorney having the best record of success in litigation in the relevant jurisdiction regarding the type of matter at issue, Litigators.org Inc. acts for the benefit of both the client and the receiving attorney. In consideration of the benefit to you, you authorize Litigators.org Inc. to present your case to other attorneys with the contingency that the case will be referred to the attorney only if the attorney agrees to provide compensation to Litigators.org Inc. as is allowed by the rules of their specific jurisdiction. You further agree that your consent to any other compensatory agreement between Litigators.org Inc. and the receiving attorney will not be unreasonably withheld.

8. Intellectual Property

Our Rights: The Service contains intellectual property owned by us or licensed to us. This includes but is not limited to software, algorithms, trademarks, logos, design elements, and content. Your Subscription grants you only the right to use the Service as intended - it does not transfer any ownership or additional rights.

Your Data: You retain all right, title, and interest in any data you provide to the Service ("Customer Data"). We acquire only the limited rights necessary to provide the Service.

9. Payment Terms

Pricing: Subscription fees are as displayed during purchase. All prices are exclusive of applicable taxes.

Payment: Payments are due according to your selected billing cycle. You authorize us to charge your designated payment method.

Taxes: You are responsible for all applicable sales, use, value-added, goods and services, or similar taxes.

Late Payment: Accounts past due may result in suspension of Service access until payment is received.

10. Term and Termination

Agreement Duration: This Agreement remains in effect during your Subscription period.

Your Termination Rights: You may terminate your Subscription at any time through your account settings or by contacting us.

The legal content included in this website is provided "as is" and neither Litigators.org Inc. nor any Litigators.org Inc. employee or agent makes any warranty (express or implied), representation or guarantee with respect thereto. Certain content may be maintained by sites other than Litigators.org Inc., and Litigators.org Inc. is not responsible for such content. Litigators.org Inc. is not creating an attorney-client or attorney-attorney relationship by providing legal content or other information on this site.

12. Disclaimers and Warranties

AS-IS BASIS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

No Guarantee of Results: We do not represent or warrant that:

Liability Cap: Each party's total aggregate liability under this Agreement is limited to the amount you paid for the Service in the 12 months preceding the claim.

Excluded Damages: NEITHER PARTY SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Except as prohibited by law, you will hold Litigators.org Inc. and its officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including attorneys' fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any federal, state, or local laws, statutes, rules, or regulations, even if Litigators.org Inc. has been previously advised of the possibility of such damage.

Any engagement of an attorney identified by Litigators.org Inc. constitutes a direct attorney-client engagement solely between the attorney and the client. The attorney, not Litigators.org Inc., is responsible for all legal advice rendered to you. Litigators.org Inc. is not responsible for the legal advice rendered by any attorney. You agree not to hold Litigators.org Inc. responsible for the legal advice rendered by any attorney, and hereby release Litigators.org Inc. from any and all claims arising in connection therewith to the fullest extent legally possible.

Third party resources that can be accessed with hypertext links from this site are not under the control of Litigators.org Inc., and Litigators.org Inc. is not responsible for any of these third-party resources. The third-party hypertext links presented on this site are provided for your convenience only. The inclusion of any link on this site does not imply any recommendation, approval, or endorsement of that site by Litigators.org Inc. or any of Litigators.org Inc. independent attorneys.

18. Modifications to Agreement

We may modify this Agreement by posting a revised version on our website or notifying you via email. Modifications required by law are effective immediately. Other modifications become effective upon your next Subscription renewal or 30 days after notice, whichever is earlier. Continued use of the Service constitutes acceptance of modified terms.

19. General Provisions

Governing Law: This Agreement is governed by the laws of the State of Florida, without regard to conflict of law principles.

Entire Agreement: This Agreement, together with any supplementary terms, constitutes the entire agreement between the parties and supersedes all prior agreements.

Severability: If any provision is found unenforceable, the remainder of the Agreement remains in full effect.

No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

Force Majeure: Neither party is liable for delays or failures due to causes beyond reasonable control, including natural disasters, acts of government, network failures, or cyberattacks.
